Terms of Use

1. Acceptance of Terms

By using the Sunset app or this website (together, the "Service"), you agree to these Terms of Use ("Terms"). If you do not agree to them, do not use the Service.

Sunset is operated by Sunset Technologies Inc., a Nevada-registered company. These Terms are a legally binding agreement between you and Sunset Technologies Inc.

2. Service Description

Sunset is an iOS app. It offers a curated selection of films to watch alongside an AI companion that talks with you about them — reacting during the film, answering questions, and discussing what you are watching. Sunset is no longer offered as a web application; this website is informational only.

The Service is currently provided free of charge. We may introduce paid features in the future; if we do, we will say so before you are charged anything.

3. Eligibility and Accounts

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian.

You create an account with Sign in with Apple or, where that is unavailable, with a one-time link sent to your email address. Your account is personal to you: do not share access to it, and tell us promptly if you believe someone else is using it.

You can delete your account at any time from inside the app, under Account. Deletion is permanent — see our Privacy Policy for exactly what it removes.

4. Acceptable Use

You agree not to:

  • Use the Service for any illegal purpose or in violation of any laws
  • Attempt to bypass any security measure, access restriction or regional availability
  • Interfere with or disrupt the Service or its servers
  • Share your account credentials with others
  • Use automated systems or bots to access the Service
  • Record, capture, download, redistribute or publicly perform any film or other content from the Service
  • Harass, abuse or harm others through the Service
  • Upload or transmit malicious code or content
  • Attempt to reverse engineer any part of the Service, or use it to train or evaluate another machine-learning system
  • Deliberately try to make the AI companion produce illegal, harmful or infringing content

5. Intellectual Property

All content, features and functionality of the Service — text, graphics, logos, icons, images, audio, video and software — belong to Sunset Technologies Inc. or its licensors and are protected by copyright, trademark and other intellectual property laws.

The films available through the Service are licensed from rights holders. You get a personal, non-transferable, non-exclusive right to stream them for your own private viewing, for as long as we offer them and you comply with these Terms. Nothing here transfers ownership of anything to you.

The catalogue changes. Titles are added and removed as licences begin and end. We cannot promise that a film you have started will still be available later.

If you believe content on the Service infringes your copyright, email hello@sunset.video with enough detail to identify the work and the material in question, and we will act on it.

6. The AI Companion

The companion is a fictional character, and everything it says is entertainment. It is generated by AI models and it can be wrong, invent things, misremember the film, or express opinions that are not ours.

Do not rely on it for factual information, and never for professional, legal, medical or financial guidance. It is not a person, not an expert, and not a source.

To hold a coherent conversation the companion keeps a record of what you have said to it and builds a short memory of you from it. Please do not tell it anything sensitive. What is stored, and how to erase it, is described in our Privacy Policy.

If the companion ever says something that seems genuinely harmful, we want to know: hello@sunset.video.

7. Service Availability

We try to keep the Service available but do not guarantee uninterrupted access. It may be unavailable because of:

  • Scheduled maintenance
  • Technical issues or outages
  • Updates and improvements
  • Circumstances beyond our control

We may modify, suspend or discontinue any part of the Service at any time. Playback quality depends on your device and your network, which are outside our control. Sending video to a television using AirPlay or Chromecast relies on your devices and on Apple's or Google's software; we cannot guarantee it works in every setup.

8. Apple

Because Sunset is distributed through the App Store, the following also apply:

  • These Terms are between you and Sunset Technologies Inc. only — not with Apple.
  • Apple has no obligation to provide any maintenance or support for the app, and no responsibility for addressing any claim that it fails to conform or infringes anyone's rights.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
  • Your use of the app must also comply with the App Store Terms of Service and any applicable third-party terms.

9. Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUNSET TECHNOLOGIES INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR TO ANYTHING THE AI COMPANION GENERATES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM AND ONE HUNDRED DOLLARS ($100). THE SERVICE IS CURRENTLY FREE, SO IN PRACTICE THIS CAP IS ONE HUNDRED DOLLARS.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent the law allows, and nothing in these Terms removes a right you have that cannot be waived.

10. Indemnification

You agree to indemnify, defend, and hold harmless Sunset Technologies Inc. and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

  • Your access to or use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you submit or transmit through the Service

11. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Nevada, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Nevada, and you consent to the personal jurisdiction of such courts.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Effective Date" above.

Your continued use of the Service after any changes constitutes acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the Service.
